High Court of Australia dismisses appeal against conviction, compulsory voting

Wednesday, April 17, 2013

Last Friday, following over two years of lawsuit over failure to participate in general election, Anders Holmdahl attended a High Full Court of Australia hearing with an audio-link from Canberra to Adelaide, South Australia, claiming voting is a right, not a duty, citing the Australian constitution. However the Justices dismissed the application for leave to appeal against conviction, ruling it had “no prospect of success” over a point that the Commonwealth Electoral Act was enacted within power.

Anders Holmdahl was represented by Kevin Borick, QC, the president of the Australian Criminal Lawyers Association, throughout the process.

Anders Holmdahl cited “fundamental distinction” between the words vote, which he defined as “exercise of free will”; right, “something you are privileged to be granted”; and duty, “something you are required to do”. After a 20-minute discourse with the lawyer representing the applicant, Justice Kenneth Hayne said, “An appeal to this Court would enjoy no prospect of success. Special leave to appeal is refused.” and adjourned the Court. Justices Stephen Gageler, Patrick Keane were also present at the hearing and participated in the verbal discourse, also enquiring the lawyer about their reasoning but not specifying reasons other than what Hayne J said. Wikinews contacted both Anders Holmdahl and the High Court and confirmed there was no other documentation of reasons behind the judgment.

The standard High Court procedures involve hearing each matter by a single Justice and only escalating it after a special leave to appeal is granted. The current case had been irregular, as the matter had been escalated to the Full Court (three Justices) directly.

The appeal also had exhausted lower means of appeal before being lodged in High Court; the Supreme Court of South Australia had dismissed it on September 24, 2012. It cited that the Australian Constitution allows each state to enact their own election laws, and the Federal Parliament has the power to make laws “with respect to … matters in respect of which this Constitution makes provision until the Parliament otherwise provides”. The Court concluded that the Commonwealth Electoral Act was legislation enacted within power.

Prior to escalation to the Supreme Full Court of South Australia, in May 2012, a single Justice Gray had forwarded the matter for consideration of Full Court (three Judges) at his discretion. This happened several months after a Magistrate had recorded the conviction following a trial in February 2012. Anders Holmdahl originally pleaded not guilty during his first Magistrates court appearance in December 2011 regarding the August 21, 2010 election.

The electoral system of Australia requires all citizens to enroll. Then they must vote at each general election — election of members of the House of Representatives and Senate of the Parliament of Australia. At the time of the election, Anders Holmdahl was enrolled as an elector on the Commonwealth Electoral Roll for the Division of Hindmarsh.

The High Full Court hearing was a last instance of appeal with further escalation only possible at international level. Anders Holmdahl had decided to take the case before the United Nations Human Rights Council.

Home-invaders pose as NYC police

Monday, July 16, 2007

In two separate incidents, men posing as members of the New York Police Department (NYPD), have invaded homes in the New York City area. In both cases, they robbed the residents, but in the most recent, they sexually assaulted a woman.

On Saturday, July 14, at 1:09 a.m. EDT (UTC-4), four men knocked on the door of a Yonkers, New York, apartment. The 33-year-old male that lives there opened the door, as the men outside wore NYPD hats and t-shirts, and had badges hanging around their necks.

The men promptly ordered the male victim to the floor. “When this guy pushed me, he had a gun in my face,” the victim said. “I could see the other guy. He motioned to the others, come on, let’s go, let’s go.” The intruders shouted “Where are the drugs?” as they ransacked the apartment.

Two of the men entered the bedroom and sexually assaulted the 30-year-old female. The couple has a five-year-old child, who was sleeping in another bedroom. “The more I resisted, the more he began to hit me,” the woman said. She said she was sexually assaulted by two of the men while her boyfriend was bound and guarded.

Police said the men then left with a cell phone, a laptop computer, a diamond ring and a gold chain. Police do not believe that they were real officers. As of this afternoon, no arrests have been made.

On Thursday, July 5, shortly after six p.m. in the East New York neighborhood of Brooklyn five men knocked on the door claiming to be “the police.” When the victims opened the door, they pushed their way in demanding the family give them drugs and money.

When police responded to a call reporting a robbery, they found the family, husband, wife and their daughter, tied up. The man suffered a head injury when he was pistol-whipped. Police say the robbers got away with a camera, jewelry, and US$5,000 in currency.

Neighbors told NY1 that they were stunned. “Frightened. Make you think twice before you want to open the door, you know,” said one of the neighbors. “Now you be asking for all this ID and stuff and even still you’re going to wonder, are they for real? So it’s kind of scary.”

There is no word about whether the two cases are connected. Yonkers is on the border of New York City, but is outside the jurisdiction of the NYPD.

Man charged with attempted murder in £40 million London jewel heist

Sunday, September 6, 2009

24-year-old Aman Kassaye, of no fixed abode, is to face a charge of attempted murder for his alleged role in an armed robbery that netted £40 million ($65 million) worth of jewelry from a London store.

Kassaye is the seventh man to be charged, and is also facing prosecution for conspiracy to rob the Graff store in New Bond Street, false imprisonment, and using a handgun to resist arrest. He will appear at Wimbledon magistrates court on Monday.

The other six men have already been remanded in custody until October 23, when they will appear at Kingston Crown Court. All are facing charges of conspiracy to rob, and two of them are also charged with a firearms offense.

43 diamond rings, watches, and bracelets were taken from the store. The theft occurred when two armed and suited men walked in and took an employee hostage. It has been reported they used prosthetic masks made from liquid latex but police have not confirmed this. Amateur footage also shows a shot was fired. No-one was injured.

The robbery is one of the biggest the United Kingdom has seen. After the crime a string of getaway vehicles was used, with police believing several more offenders assisted with this stage of the plan. Although The Telegraph claims no stolen property has yet been recovered, this is also unconfirmed by police.

What Accessories Should You Look For When Buying A Car?

What Accessories Should You Look For When Buying a Car?

by

Graham Winston

A lot of people like to save money by purchasing a used car. Everybody knows the basics when it comes to test driving and checking for leaks. One of the most important things to remember about buying a used car is that there are certain accessories, fiat accessories, ford accessories, and chevy accessories that can increase the value of a used car. Let\’s take a look at some of the most sought after accessories that sellers can add to a car to really make it worth its weight in gold.

Led car bulbs is one important thing to expect on any used auto. As with LED house lights, led car bulbs carry many advantages that are important to consider. They are brighter, produce a better quality of light, last longer, and they eat up less battery power. LED bulbs need to be changed only a few times the entire life of a car. The engine is likely to die before three sets of led bulbs are installed.

Car mud flaps are another example of an accessory that is simple yet quite effective. Let\’s forget for a moment how cool they make the car look and remember that they do serve the very practical purpose of keeping mud off of the tires, hub caps, and out of the wheel wells! Car mud flaps are fashionable and useful at the same time.

Depending on the age of the car, one important thing to look for might be seat covers. Even if the original seats are still in acceptable shape, seat covers help to keep them that way and many people overlook this simple fact. Also, consider that seat cushions can be added to auto seats too, and these cushions help make the ride a more comfortable one. One could even luck out and buy a car that has seat covers with the cushions built right in.

High tech accessories never hurt either. If somebody has a mounted GPS installed, this can make a used car all the more valuable. After all, these sorts of devices come in handy when one does quite a bit of driving in cities that one is not familiar with. Students find such devices to be of great assistance as they manoeuvre through new college towns their first years away from home. Let\’s not forget that students also make up a large portion of used car buyers as well.

Try to make sure the accessories fitted are correct for the specific car for example Fiat accessories on Fiat cars and know you model as often they come pre-installed by the manufacturers but some are added by the seller which can affect the true value of the vehicle. Asking this question is important as well as having someone with technical mechanical knowledge with you for the purchase.

Belgrade: demonstration against independent Kosovo escalates into riots

Thursday, February 21, 2008

In Serbia’s capital Belgrade protesters have broken into the United States embassy, and have set fire to an office, which is now extinguished. The break-in followed massive protests against Kosovo’s independence that was declared last Sunday. A couple of hundreds of thousands protested in front of the parliament building in Belgrade when masked attackers broke into the building and tried to throw office-furniture out the windows. Estimations of a number of protesters vary between 150.000 and 2 millions.

Around 18:00, after the relay, a couple hundred rioters went to Kneza Milosa Street where the US embassy is located. At 18:15 they demolished a part of the embassy and burned it. They also attacked the Croatian embassy, which is around 100 meters from the US embassy on the same street. Around 19:00 police came and clashed with the rioters using tear gas. Riots were all over downtown Belgrade. As of 22:00 the situation was under control but there are still some riots in other streets.

The tear gas polluted a couple blocks, about 350 meters up to Vra?ar hill.

The nearby Croatian embassy was also attacked. Rocks were thrown at the Canadian embassy building. This could be due to the fact that Canada has not said yet if it recognises Kosovo. Embassies of Turkey, Bosnia and Herzegovina, Belgium, United Kingdom and Germany were also attacked.

One person was found dead at the ground floor of US embassy, around 150 people were injured, including 35 policemen. Around 100 rioters were arrested.

Dirk-Jan Visser, a photo-reporter for the Dutch newspaper NRC Handelsblad was attacked by rioters. People helped him escape, and he has been taken into hospital with broken bones. He is expected to be kept in hospital until the next day. Ambulances and medical cars were called to the scene to help injured people and protesters, some cars were attacked.

Andrey Fyodorov and Andrey Pavlov, journalists of Russia Today, were also heavily attacked during the riots.

Two McDonald’s restaurants on squares Terazije and Slavija were attacked. The restaurant on Slavija has been heavily damaged. Kiosks, stores and banks were robbed all over the centre of Belgrade. The protesters tried to attack radio/television station B92 but police had the scene under control.

“As long as we live, Kosovo is Serbia,” Prime Minister Vojislav Kostunica told the crowd from a stage in front of the old Yugoslav parliament building in Belgrade, “We’re not alone in our fight. President Putin is with us”. A huge banner reading “Kosovo is Serbia” draped the front of the building.

In Washington, State Department spokesman Sean McCormack called out to the Serbian government to protect the U.S. Embassy. He said the U.S. ambassador was at his home and was in contact with U.S. officials.

The United States was one of the first countries, with the United Kingdom, France and Germany to recognize Kosovo as an independent state. Serbia however regards Kosovo as a province and is backed up in this by Russia, China and numerous other countries, including some European Union member states. Kosovo is 90% ethnic Albanian, with in the north a minority of ethnic Serbians. Belgrade has, however, not been in control over the Kosovo area since 1999, when United Nations took control.

High representative of the Serbian Radical Party, Aleksandar Vucic, said that “those who provoked Serbian people are equally responsible for destruction as rioters are.” President of Serbia Boris Tadic and President of the National Assembly Oliver Dulic and other ministers called on peace.

Millions of old New Zealand coins still to be handed in

Wednesday, October 25, 2006

On November 1, 2006 the old five, ten, twenty and fifty cent coins will be illegal tender, but the Reserve Bank of New Zealand says there are still at least 100 million still to be returned.

According to the Reserve Bank, most of the old coins have been lost in drains or buried in rubbish. “We think there is still another 100 million sitting around in people’s homes,” Brian Lang, currency manger for the Reserve Bank, said.

Lang said: “So far, just over 280 million coins have been returned, but there are more out there. Since 1967 the Reserve Bank has issued more than a billion of the old ‘silver’ coins. So if you don’t want to be stuck with loads of old coin – there’s never been a better time to empty your coin jars, sweep the car glove box and rummage behind the couch cushions.”

The coins still awaiting to be handed in, by either spending them, taking them to a bank or donating them to charity, are estimated to be worth between NZ$5 million and $50 million.

“A last-minute burst of publicity may convince people to bring the coins in. It’s a bit of a hassle though. Human nature being what it is, people just don’t care,” Lang said. The Karori Wildlife Sanctuary located in Wellington say that they have collected over $9,000 in old coins. Sanctuary spokesman, Alan Dicks said: “The campaign was particularly fitting because the old coins depicted tuataras and kiwis, both of which can be found living at the sanctuary. The money will go towards supporting general ecological restoration of the sanctuary. We want to get over ten grand, but the more the better.”

Lang said: “Though the coins will no longer be legal tender, banks will continue to exchange them until at least the end of the year,” and the Reserve Bank will always exchange them. “We are still getting people coming in with two-dollar notes,” Lang added.

Two slain in knife attack at Swedish IKEA furniture retailer

Tuesday, August 11, 2015

Two people were killed yesterday afternoon and another seriously injured in Västerås, Sweden. The injured man is considered a suspect in the knife attack and was arrested in hospital. Another man was arrested at the scene, which was an IKEA furniture retailer. According to police, the two fatalities do not have any obvious connection to the suspects, but did know each other. The motive is, thus far, unknown.

Police were called to the scene at 13:00 local time and found three stab victims. Initially, all three were considered victims, but the status of one has been changed to suspect. The other two, a man and a woman, subsequently died from their wounds. Police have said CCTV is helping in the investigation. Local newspaper Vestmanlands Läns Tidning (VLT) has reportedly posted footage of one of the suspects being tackled by police.

VLT has further claimed to have identified the two victims as a mother and son, aged 55 and 28 respectively. According to the paper, the victims were not local residents, but did have a connection with Västerås, where they were vacationing at the time of the attack, which a police spokesperson has called “an act of madness”((sv)).

“This is the worst working day of my life”((sv)), said Mattias Johansson, the store manager of IKEA in Västerås, to Sveriges Television. IKEA spokesperson Anna Pilkrona-Godden told BBC News, “Our thoughts are with those affected,” and said the store is closed for the time being.

Västerås is in central Sweden, approximately 115 km (70 miles) west from the capital Stockholm. The population is roughly 110 thousand.

How Teens Can Make Cash

By Mario Churchill

Teenagers are always looking for ways to make cash. With the high cost of designer clothing, NFL sports wear, music and movies, parents simply cannot afford everything that a teenager wants. Most teens know that the only way that they can get the things they want is to make cash. Unfortunately, many states have changed the driving laws to only allow drivers over the age of eighteen unlimited privileges. This makes getting cash much harder for the average teenager. Here are some ways that you can make cash as a teen when you do not have that driving freedom.

The best way for teens without a car or license to make cash is through the people in their own neighborhood. These are the people that you grew up with. You can trust them and they can trust you. After all, if you scam them or do not do a good job, they know your parents and they know where you live! The first thing that you should do when you want to make cash is go door to door in your neighborhood and find out what services people need or want.

Often teens can make cash by working for busy households or retirees by mowing lawns, raking leaves, or dog walking. Gardening, window washing, washing cars, general house cleaning, or trimming hedges can also be great ways to make cash as a teenager. If there are a lot of families in the neighborhood, you can even try posting flyers offering cheap after school and weekend babysitting.

YouTube Preview Image

Another way that teens can make cash is through a paper route. Many large newspapers now require carriers to be eighteen or older. However, smaller community papers often still allow teens to run their paper routes. This can be done easily on a bicycle, motor bike, skateboard, or on foot. Locally run small businesses may also allow teens to make cash by distributing flyers throughout their neighborhood.

If all else fails, teens can go around to local businesses within walking distance. Most convenience stores require workers to be over eighteen or twenty one. However, grocery stores will hire teens as stockers and fast food joints will hire teens as cooks. You can also check out local small movie theaters for cleaning or ushering jobs. These types of jobs will give teens the ability to make the most cash. However, in some areas these types of jobs are few and far between.
